BALANCED DOSE TERMS OF SERVICE

Firefly Medical Group PLLC d/b/a Balanced Dose (“we,” “us,” “our”) operates this website and online store, including all related content, features, tools, and services (the “Services”). Our storefront is powered by Shopify, which helps us provide secure ordering, payment processing, and website functionality.
OVERVIEW
These Terms of Service (the “Terms”) govern your access to and use of the Services.
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state or province of residence and that any minors using your devices to access the Services do so with your consent.
You may be required to provide certain information (such as email, billing details, or shipping information). You represent and warrant that all information you provide is accurate, current, and complete, and that you have all necessary rights to provide it.
You are solely responsible for:
- Maintaining the security of your account credentials
- All activity occurring under your account
Accounts may not be transferred or assigned.
SECTION 2 – OUR PRODUCTS
We strive for accurate product descriptions, but product appearance (including color) may vary based on your device settings.
We do not guarantee that:
- Product images reflect actual appearance, or
- Products will meet your personal expectations
Product descriptions, formulations, pricing, and availability may change at any time without notice. We may limit quantities or discontinue products at our discretion.

Balanced Dose sells dietary supplements, which are not intended to diagnose, treat, cure, or prevent any disease. Information on the Services is for general wellness and educational purposes only and is not medical advice. Always consult a qualified healthcare provider before using any supplement.
SECTION 3 – ORDERS
By placing an order, you make an offer to purchase. We may accept or reject your order for any reason. Your order is not accepted until we send an order confirmation.
We may be unable to cancel or modify an order after acceptance.
All purchases are subject to our Refund Policy.
You represent and warrant that purchases are for personal use only, not for resale, distribution, or export.
SECTION 4 – PRICES AND BILLING
Prices, promotions, and discounts are subject to change without notice. Posted prices exclude taxes, shipping, handling, and import duties unless stated otherwise.
You agree to:
- Provide complete and accurate purchase and payment information
- Update your information promptly (billing address, card details, etc.)
You represent and warrant that:
- The payment method used is valid and authorized.
- All charges incurred will be honored.
- You will pay all applicable charges, including taxes and shipping.
SECTION 5 – SHIPPING AND DELIVERY
Delivery estimates are provided for convenience only and are not guaranteed.
Once we deliver products to the carrier:
- Title and risk of loss transfer to you; and
- We are not responsible for delays, carrier errors, customs processing, or events outside our control
SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services—including text, images, graphics, video, audio, designs, product names, and layout—is owned by Balanced Dose, its affiliates, or licensors, and is protected by U.S. and international intellectual property laws.
Your access to the Services grants you a limited, revocable, non-exclusive license for personal, non-commercial use.
You may not:
Reproduce, distribute, modify, or create derivative works
- Copy, frame, scrape, or mirror the Services
- Use trademarks or branding without prior written permission
All rights not expressly granted are reserved.
SECTION 7 – OPTIONAL TOOLS
You may access third-party tools made available through Shopify or other partners. These tools are provided “as is” without warranties or endorsement.
Your use of such tools is at your sole discretion and subject to the applicable third-party terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links or embedded features from third-party websites.
We are not responsible for:
- Their content
- Their privacy or security practices
- Any damage or loss arising from your use of third-party sites
Review third-party policies before engaging in any transaction with them.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Balanced Dose is powered by Shopify, which provides e-commerce infrastructure and payment processing. However, your purchase contract is solely with Balanced Dose, not Shopify.
You expressly release Shopify from any liability arising from or related to your purchases or interactions with our Services.
SECTION 10 – PRIVACY POLICY
Your personal information is processed according to our Privacy Policy, and certain information is also processed by Shopify under its privacy policy (https://www.shopify.com/legal/privacy).
Because Shopify hosts our store, information you submit may be transmitted to Shopify or its subprocessors, potentially in other countries.
By using the Services, you acknowledge and agree to both privacy policies.
SECTION 11 – FEEDBACK
If you submit any ideas, reviews, comments, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute such Feedback for any lawful purpose.
You represent that:
- You own the Feedback or have rights to submit it
- Your Feedback complies with these Terms
- Your Feedback contains no unlawful or harmful material
We may moderate or remove Feedback at our discretion.
SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, information on the Services may contain errors or inaccuracies (pricing, promotions, availability, etc.). We may correct or update information and cancel orders at any time, including after submission, without prior notice.
SECTION 13 – PROHIBITED USES
You may not use the Services for any unlawful, harmful, or abusive purpose, or in any way that could impair the Services, violate others’ rights, or interfere with our operations.
Prohibited conduct includes:
- Illegal activity
- Harassment, defamation, or abuse
- Uploading malware
- Collecting personal information of others
- Scraping or crawling
- Bypassing security measures
- Misrepresenting your identity
- Accessing the Services for any competitive or commercial purpose, including to collect data, copy product designs or images, analyze ingredient lists, develop competing products, or create derivative content
- Using bots, scrapers, crawlers, extraction tools, or any automated means to sabotage operations or to access, copy, index, or download any portion of the Services
- Reverse engineering, duplicating, or otherwise exploiting any part of the Services for the benefit of a competitor
We may suspend or terminate access for any violation.
SECTION 14 – TERMINATION
We may suspend or terminate your access to the Services at any time without notice. You remain responsible for all charges accrued before termination.
Sections that logically survive termination (e.g., Intellectual Property, Limitations of Liability, Indemnification) remain in effect.
SECTION 15 – DISCLAIMER OF WARRANTIES
Except as expressly stated, the Services and all products are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind—express or implied—including merchantability, fitness for a particular purpose, durability, or non-infringement.
We do not guarantee uninterrupted, secure, or error-free operation of the Services.
Some jurisdictions do not allow certain warranty disclaimers; those limitations may not apply to you.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law:
Balanced Dose and its affiliates, employees, service providers, partners, and Shopify shall not be liable for any indirect, incidental, punitive, consequential, or special damages, including lost profits, lost data, replacement costs, or business interruption, arising from your use of the Services or purchased products.
Our total liability shall not exceed the amount you paid for the product giving rise to the claim.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless Balanced Dose, Shopify, and their affiliates, officers, employees, contractors, and agents from any claims or damages arising out of:
- Your use of the Services
- Your breach of these Terms
- Your violation of any law or third-party right
We may control the defense of any indemnified claim.
SECTION 18 – SEVERABILITY
If any portion of these Terms is deemed unlawful or unenforceable, the remaining provisions shall remain valid and enforceable and the unlawful or unenforceable portion shall be enforced to the maximum extent permitted by law.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Failure to enforce any right is not a waiver.
These Terms and posted policies (including the Privacy Policy and Refund Policy) constitute the entire agreement between you and Balanced Dose.
Any ambiguities shall not be construed against the drafting party.
SECTION 20 – ASSIGNMENT
You may not assign your rights under these Terms without our written consent.
We may assign our rights without notice.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of the State of North Dakota and applicable U.S. federal law.
You consent to jurisdiction and venue in North Dakota courts.
SECTION 22 – HEADINGS
Headings are for convenience only and do not limit the Terms.
SECTION 23 – CHANGES TO TERMS
We may update these Terms at any time. Material changes will be communicated as required by law. Your continued use of the Services means you accept the updated Terms.
